How to apply for TN Visa?

How to apply for TN Visa?

The procedure for obtaining a TN visa differs for Canadian and Mexican citizens. Canadian citizens are visa-exempt and can apply for their TN status directly at a Class A port of entry, such as a major international airport or land border crossing.

Mexican citizens must apply for a TN visa at a US Embassy or Consulate abroad before being admitted to the United States with TN status.

Alternatively, suppose a Canadian or Mexican citizen is already in the United States with another valid nonimmigrant status. In that case, they can apply for a change of status to TN status from within the United States by submitting an application to USCIS.

There are two types of TN status for which these citizens can apply. A TN-1 is for Canadian citizens, and a TN-2 is for Mexican citizens.

TN-1

  • The employers need to submit an I-129 (Petition for Nonimmigrant Worker) with the TN visa application.
  • Apply for TN nonimmigrant status at a CBP-designated U.S. port with proof of Canadian citizenship, employment letter and credentials evaluation (if applicable).

TN-2

  • Submit the DS-160 and required documentation to a U.S. Embassy or Consulate.
  • Attend an interview at a U.S. Embassy or Consulate and receive a visa number.
  • Once approved, applicants can apply for entrance at select CBP-designated U.S. ports.

The applicant must be entering the United States to engage in professional activities in a profession that is listed in Chapter 16, Appendix 2 of the USMCA. The list includes 63 professions that someone may qualify for a TN visa. Each listed profession has its own educational and experience requirements.

The applicant must not only meet the criteria for the specific professional category listed below, but the position being offered by the U.S. employer must also require someone filling the role have meet the same requirements as a minimum to qualify for the position.
