What is the EB-1C Green Card?

An EB-1C immigrant visa is the third category within the first preference, employment-based immigrant visa classification. Specifically, EB-1C immigrant visas are for certain multinational managers or executives wishing to transfer to the U.S permanently.

To qualify for this type of immigrant visa, an applicant must have worked for a business entity located outside the U.S. that is a parent, branch, or subsidiary with a business in the U.S. The applicant must have worked for their overseas company or other business entity for at least one year during the three years before the application submission to qualify as a multinational executive or manager under this preference. As with the other subsections under first preference employment visas, specific qualifications must be satisfied to qualify as an Executive or Senior Manager.

EB-1C Requirements

U.S. Employer Requirements:

  • The U.S. company must be in a qualifying relationship with the applicant's foreign company (parent, subsidiary, affiliate, etc.)
  • The employing company must have operations in the U.S. and one other country for the entire duration of the applicant's stay in the U.S. The two entities' relationship can be directly connected or through a subsidiary.
  • The U.S. company must have been active/operating in the U.S. for at least a year.

Employee Requirements:

  • The senior manager or executive must have spent at least one year working for the associated foreign company outside of the United States within the three years before filing their Immigrant Visa application. The applicant's role during that one year must have been management or executive responsibility for the overseas company.
  • The applicant must intend to immigrate to the U.S. to work in a senior managerial or executive capacity with the U.S. employer.

To qualify as a Manager, the applicant must show that they will:

  • Manage a department or function inside the company.
  • Have the authority to hire, fire, and make other supervisory decisions regarding employees.
  • Supervise and control the work of other supervisors or professional-level employees or manages an essential function within the organization.
  • Exercise discretion over the day-to-day activities of those employees.

To qualify as an Executive, the applicant must show that they will:

  • Direct the overall management of the organization, major function, or major component
  • Must exercise a wide latitude of discretionary decision-making.
  • Make significant decisions without substantial supervision.
  • Set broad goals and guidelines.
  • Received only very general supervision from superior executives, the board of directors, or stockholders.
