There are many benefits associated with the TN visa for Canadian and Mexican citizens who wish to live and work in the United States temporarily. The TN visa is sometimes compared to another nonimmigrant work visa, the H-1B. While there are some similarities between the two, the TN Visa benefits for qualifying Mexican and Canadian nationals may make it a more attractive option for many.
Period of Stay:
The initial period of stay for Canadian citizens is up to 3 years. For Mexican nationals, the initial period is generally given for 1 year.
Unlike similar visas like the H-1B, which have a six-year maximum stay, the TN allows applicants to maintain status indefinitely in three year increments as long as a viable job is being offered and the applicant remains qualified for the role.
For Canadian citizens, applying for TN status at the border can be completed in a matter of hours. Similarly, for Mexican citizens, depending on visa appointment wait times at the consulate, applying for the TN Visa happens simultaneously with the TN interview. It can be completed in as little as a few weeks. There are no lengthy wait times and application processing times with the government required.
No Annual Cap:
Unlike the H-1B, which has an annual cap of 85,000 visas for new applicants, the TN Visa does not have a yearly quota.
Compared to other visa classifications, the TN Visa is relatively inexpensive. Unlike the H-1B, which must be processed through USCIS, the applicant can avoid expensive government filing fees by processing the application for TN status at a consulate or Class A port of entry abroad.
Dependent family members, including spouses and children under the age of 21, are eligible to accompany the TN Visa applicant to the US in TD status. While TD status does not allow for employment, they may attend school full-time.
