TN under USMCA

Are you a Canadian or Mexican citizen who would like to work in the U.S.?

The TN visa is available only to Canadian and Mexican citizens. The TN visa allows U.S. companies to hire Canadian and Mexican citizens who work in specific professional occupations outlined in Chapter 16 of Appendix 2 of the U.S.-Mexico-Canada (USMCA) agreement to work in the United States. Generally speaking, the professions listed require at a minimum a bachelor's degree related to the position offered by the U.S. employer to qualify. 

Unlike most employment-based visas, the TN does not require that a U.S. employer must have an approved TN application before the foreign national employee can seek a visa. Rather, TN visa applicants may apply for the TN status directly at the U.S. Consulate abroad and Canadian TN applicants can apply directly at the port of entry.  

We recommend U.S. employers or any Canadian or Mexican citizen who has a job offer from a U.S. company begin the application process early to avoid any delays in your start date and to avoid potentially lengthy visa appointment wait times.  

To qualify for TN Nonimmigrant Status, the applicant must be:

• a citizen of Canada or Mexico
  
• The profession qualifies under the regulation
  
• The position in the United States requires a NAFTA professional
  
• The applicant has a prearranged full-time or part-time job with a U.S. employer (but not self-employment)
  
• The applicant has the qualifications to practice in the aforementioned profession
