The H-1B Visa program allows employers to hire foreign workers who possess a bachelor's degree or higher and have highly specialized knowledge in the specific occupation. This temporary work visa allows U.S. employers to hire foreign workers into specialty occupations that require a bachelor's degree or its equivalent.
Initial H-1B applications are subject to an annual lottery. If your employee has been selected in the annual lottery, we can assist in the H-1B filing with USCIS.
If you are a U.S. employer wishing to hire a new employee or continue sponsoring a current employee who already holds an H-1B, you do not have to submit a new lottery registration on the employee's behalf. Current H-1B holders can transfer or extend their H-1B status with the same or a new employer at any time.
The H-1B classification is generally granted for 3 years at a time with a maximum duration of 6 years for any extension requests.
Dependent family members, including spouses and any children under 21 may accompany the H-1B visa holder to the U.S. in H4 status. The H4 spouse is permitted to work in the U.S. if the H-1B holder has an approved I-140.
We recommend beginning the H-1B petition as soon as possible as annual lottery limitations and government processing times may impact how soon your employee can begin working with your company.
Requirements
To qualify for an H-1B Nonimmigrant Visa, the applicant must be:
- The employee must have an offer of employment from a U.S. employer;
- The job must qualify as a "specialty occupation,"
- The employee must have the minimum requirements necessary for the specialty occupation at the time of application, which must be at least a bachelor's degree in a specific field of study, and any licenses, certifications, or other specific requirements for the position.
- The employer must agree to certain conditions, including payment of the required wage.
- H-1B status is limited to 6 years, inclusive of all employers; the 6-year period starts over after an employee has left the U.S. for one full year.
- First time applicants are subject to an annual lottery before being eligible to apply
